To enter the draw to win, enter your details and your answers to the questions asked.

5 finalists (one from each of NSW/ACT, VIC, QLD, SA and one from WA/NT/TAS) will be drawn and asked to attend the Today Show on 21st November 2007. These finalists will take part in an activity on the Today Show to determine who will win 1st, 2nd, 3rd, 4th and 5th prizes.

 

PRIVACY

Entrant personal information ("PI") will be collected to enable the Promoter to administer and promote this competition and its winners and, if an entrant consents, may be used to market its services to the entrant. The PI of winners may be provided to others assisting, including prize suppliers and deliverers, and to authorities that regulate this competition. Entrants may contact the Promoter at the address given below to request access to any of their collected PI that is still held. If an entrant does not truthfully provide all requested PI, the Promoter may determine that they are not eligible to win a prize.

First Draw for 5 finalists

There are 5 prizes to be awarded in the first draw. Each of those prizes will be EITHER Prize A or Prize B. The maximum total prize value of each prize (whether being a Prize A or Prize B) is A$4,425

If the winner establishes their entitlement to the prize on or before 5pm AEDT on 19/11/07 he or she will win a Prize A. Otherwise, if a winner establishes their entitlement to the prize after that time, he or she will win a Prize B.

Prize A comprises, for the winner and, subject to the other provisions of this condition 1.14A and condition 1.15A, one guest of their choice:

(i) Except where Melbourne is the capital city nearest to the winner's place of residence, return economy flights to Melbourne, from the Australian State or Territory capital city nearest to the winner's place of residence;

(ii) 2 nights twin share accommodation at the Grand Mercure Docklands (the "Hotel");

(iii) subject to circumstances prevailing on 21/11/07, entry to the area of Waterfront City

Docklands VIC 3008 ("Studio") where the Today Show is expected to be filmed on 21/11/07 and an appearance on that show while the second activity is being conducted;

 

(iii) if flights to and from Melbourne are included in the prize, return ground transport between Melbourne airport and the Hotel; and

 

(iv) return ground transport between the Hotel and the Studio.

 

Prize A (except as expressly stated) does not include:

(i) if flights are provided, transportation between the traveller's residence and the departure airport or any other expenses prior to departure from or after return to the departure airport;

(ii) any other transport;

(iii) any meals;

(iv) any insurance (such as travel or health cover);

(v) any other ancillary costs (at the hotels or elsewhere) which may be incurred by the winner or their guest.

Prize B comprises the same components as Prize A, except that instead of attendance at the Studio, the Promoter will provide alternative entertainment of the Promoters choice. No television appearance will be included with Prize B

This prize includes the following on road costs, the maximum value of which will vary depending on the State or Territory in which the Vehicle is registered. The on road costs are dealer delivery and statutory government charges and one year's registration (in the State or Territory in which the winner resides) and compulsory 3rd party personal insurance (CTP/TAC, etc) for private use.

Additional Prize Conditions

 

1.15A

Additional Prize Conditions applicable to each prize in first draw:

The components of each first draw prize (whether Prize A or Prize B) must be taken together as a single trip to be booked by the Promoter.

Any part of the prize that is not taken for any reason is forfeited.

The winner is free to select any person as their guest, provided that if the winner will be less than 18 years of age at the commencement of travel, their guest must be a parent or guardian of the winner. The Promoter may require the guest to confirm in writing that they agree to comply with the provisions of these conditions relating to them. If a winning entrant's guest does not agree to comply with any of those provisions, the entrant will forfeit their prize.

Travel and accommodation are for the winner and one guest travelling together.

 

The prize cannot be exchanged for other travel or accommodation at other destinations.

 

Prize B is subject to the availability of flights and accommodation at the time of booking and must be completed on mutually acceptable dates no later than 29/11/08.

Additional Prize Conditions applicable to First Prize in second activity:

To be eligible to claim the First Prize, the winner must be capable of obtaining motor vehicle registration of the Vehicle in his or her name in accordance with the applicable legislation in the State or Territory in which the winner resides. If the winner is, through any legal incapacity or otherwise, unable to register the Vehicle in his/her name then he/she may, notwithstanding any other provision of these conditions, transfer his/her Vehicle prize to another person with legal capacity for the purpose of registering the Vehicle in the State or Territory in which the winner resides.

The First Prize winner must collect the Vehicle from the dealer specified by the Promoter and it must be registered prior to collection. Any number plate details used in the promotion of the Competition are representational only.

The Vehicle prize excludes any optional extras. The Vehicle colour is subject to availability. The supplying dealer will not provide a substitute model or exchange the Vehicle for cash.

Unless expressly stated within these Conditions, all expenses incurred in relation to the Vehicle prize (including insurance) are the responsibility of the winner.

2. WHO MAY ENTER

The only persons who may enter and be awarded prizes are those who (i) are residents of the place specified in Condition 1.1, (ii) meet the criteria, if any, specified in Condition 1.2 (iii) if an age is specified in Condition 1.3, have attained the age specified in that Condition, (iv) are not (a) employees of, or contractors to, the Promoter or any of its agencies involved with this competition, or of any entity specified in Condition 1.4, or (b) members of the immediate family of any such employees or contractors.

 

"Immediate family" means spouse, defacto spouse, parent, natural or adopted child, and sibling (whether natural or adopted by a parent), whether or not they live in the same household as the employee/contractor.

 

3. ENTRANTS BOUND BY CONDITIONS

By participating, entrants agree to be bound by these conditions.

 

4. ENTRY INSTRUCTIONS

Entry instructions form part of these conditions.

 

Where SMS entry is permitted, SMS entries may only be sent from the entrant's own mobile phone. SMS entries sent from other sources (eg computers) are invalid.

 

5. AUTOMATIC AND NON-PERMITTED ENTRIES

Any entry that is not lodged by the Promoter, that is lodged by automatic, repetitive, robotic, programmed or similar entry methods or agents, including the use of a competition entry service, will void all entries by that entrant.

 

The Promoter may, at its absolute discretion, declare any or all entries made by an entrant invalid if the entrant: (i) fails to establish their entitlement to enter the Competition to the Promoter's satisfaction; or (ii) submits an entry which is not in accordance with these conditions.

 

6. NUMBER OF ENTRIES PER ENTRANT

An entrant may enter no more than the number of times specified in Condition 1.5.

 

7. COST OF ENTRY

Where entry is permitted by SMS, 1900/1902 call or post, the cost of submitting each permitted entry, including any GST, is as specified in Condition 1.6

 

8. DURATION

This competition commences at the Sydney time specified in Condition 1.7 on the date specified in Condition 1.8.

Entries must be received by the Sydney time specified in Condition 1.9 on the date specified in Condition 1.10.

 

9. DRAWS TO DETERMINE WINNERS

9.1 FIRST DRAW

The first draw will take place at the address specified in Condition 1.11 at the Sydney time specified in Condition 1.12 on the date specified in Condition 1.13. All valid entries received will be included in the first draw.

 

Entries will be drawn until one valid entry has been drawn from each of the following five geographic areas:

(i) New South Wales and ACT

(ii) Victoria, (iii) Queensland

(iv) South Australia

(v) Western Australia, Northern Territory and Tasmania

The entrants who submitted each of the valid entries that is the first such entry drawn from each of those geographic areas (5 entries in all) will each win one of the First Draw prizes, as described in Condition 1.14A.

The postcode in each entry determines where from the user is from

 

9.2 SECOND Activity

The second activity will take place at the address specified in Condition 1.11 at the Melbourne time specified in Condition 1.12 on the date specified in Condition 1.13. The second prize activity will be used to decided the winners of the first, second, third, fourth and fifth prizes.

 

The entrant submitting the:

(i) first winner in the second activity will win the First Prize, as described in Condition 1.14B;

(ii) second winner in the second activity will win the 2nd Prize, as described in Condition 1.14B;

(ii) third winner in the second activity will win the 3 Prize, as described in Condition 1.14B;

(iv) fourth winner in the second activity will win the 4th Prize, as described in Condition 1.14B; and

(v) fifth winner in the second activity will win the 5th Prize, as described in Condition 1.14B.

 

9.3 ATTENDANCE AT SECOND ACTIVITY

The conduct of the second activity (in whole or part) may be televised on the Today Show on 21/11/07. The Promoter expects that winners of the five prizes in the first draw will each be invited (but not required) to attend the second activity at the Studio referred to in Condition 14A and, if so invited, to appear on the Today Show on 21/11/07. If a winner of one of the five first draw prizes does not attend the second activity at the Studio for any reason whatsoever, the Promoter may nominate another person to appear on the Today Show as a representative of the winner while the draw is being conducted.

 

9.4 ENTRY VALIDITY

An entry that does not include answers to all the Competition questions asked, that are, in the Promoter's view, the correct answers to those questions, is not a valid entry.

 

The Promoter's decisions are final and the Promoter will not enter into any correspondence.

 

10. PRIZE(S)

The prizes, and their individual values in Australian dollars, are as specified in condition 1.14 (including condition 1.14A and 1.14B). The Promoter takes no responsibility for any variations in prize values.

 

The awarding of prizes is subject to the conditions, if any, specified in Condition 1.15 (including condition 1.15A and 1.15B).

 

The maximum total value of all prizes in this competition, in Australian dollars, is as specified in condition 1.16.

 

Except with the written consent of the Promoter, prizes are not transferable or exchangeable and non-cash prizes cannot be taken as cash. The Promoter has absolute discretion as to whether it will provide such consent and need not provide any reasons to any person for providing or withholding consent.

 

If a prize, or any part of a prize, is "cash", the "cash" will be paid by cheque drawn in favour of the winner.

 

In the event that any prize item is unavailable, the Promoter reserves the right, subject to the approval of any relevant trade lottery authority, to substitute a prize item of equal or greater value.

 

 

11. WINNER NOTIFICATION

The winner(s) will be notified by the means specified in Condition 1.17, using the contact details provided in their entry.

 

12. WINNER PUBLICATION

The name and suburb of the winner(s) of prizes valued at more than $100 will be published (i) in the publication specified in Condition 1.18 on the date specified in Condition 1.19, and (ii) on the website specified in Condition 1.20, from the date specified in Condition 1.21 until the date specified in Condition 1.22.

 

13. UNCLAIMED PRIZES

Subject, where relevant, to any written directions given under the legislation regulating this promotion, if a prize is unclaimed by the winner drawn under Condition 9, (i) that winner will forfeit all entitlement to their prize, and (ii) the prize will then be awarded in a further draw to be held at the time, on the date and at the place specified in Condition 1.23. The names and suburbs of the winner(s) in this draw of prizes valued at more than $100 will be published in the publication specified in Condition 1.24 on the date specified in Condition 1.25.

 

14. TAXES

Any taxes which may be payable as a consequence of a winner receiving the prize are the sole responsibility of the winner.

 

15. NO QUALITY, ETC, REPRESENTATIONS

The Promoter makes no representations or warranties as to the quality/suitability/merchantability of any of the goods/services offered as prizes.

 

16. EXCLUSION OF LIABILITY

To the extent permitted by law, the Promoter is not responsible or liable for:

(i) inaccurate / incorrect transcription of entry information,

(ii) purported entries that are not received for any reason, including because they are lost, misdirected or stolen, or that are received, but are late, illegible, incomplete, sent with insufficient postage (where entry is by post), or sent other than as directed in the entry instructions,

(iii) any problems or technical failures of any kind, including malfunction of any telephone network or lines, computer online systems or network, servers or providers, computer equipment, or software,

(iv) the unavailability or inaccessibility of any service whether or not caused by traffic congestion on the Internet or at any Website,

(v) unauthorised human intervention in any part of the competition,

(vi) electronic or human error which may occur in the administration of the competition,

(vii) any loss suffered or sustained, to person or property and including, but not limited to, consequential (including economic) loss by reason of any act or omission, deliberate or negligent, by the Promoter, or its servants or agents, in connection with the arrangement for supply, or the supply, of any goods or services by any person to a prize winner and, where applicable, to any family/persons accompanying a winner,

(viii) any injury or damage to persons or property, including to the participant's or any other person's computer related to, or resulting from, participation or downloading any materials in this competition.

 

A winner, and his or her guests (if any), must sign and return any liability release and indemnity provided by the Promoter and/or its contractors as a condition of a prize being awarded. If a winner is under 18 years, a parent or guardian must also sign any provided liability release and indemnity as a condition of the prize being awarded. Failure to return the signed releases and indemnities will result in the entitlement to the prize being forfeited and the selection of another winner.

 

This condition does not affect, and is not intended to affect, any rights a consumer might have, which cannot be excluded under applicable consumer protection laws. To the fullest extent permitted by law, any liability of the Promoter or its servant or agents for breach of any such rights is limited to the payment of the cost of having the prize supplied again.

 

17. OWNERSHIP OF ENTRIES

All entries become and remain the property of the Promoter.

 

18. PUBLICITY

The winners consent to the use of their name, suburb of residence and image for promotional and marketing purposes and agree to participate in reasonable promotional activities as requested by the Promoter.

 

19. TAMPERING AND OTHER FAILURES

If for any reason this competition is not capable of running as planned, including infection by computer virus, bugs, tampering, unauthorised intervention, fraud, technical failures or any other causes beyond the control of the Promoter which corrupt or affect the administration security, fairness, integrity or proper conduct of this competition, the Promoter reserves the right in its sole discretion to disqualify any individual who tampers with the entry process or who may benefit from such tampering and, subject to the approval of those authorities that have issued permits for the conduct of this competition, to cancel, terminate, modify or suspend the competition.

 

CAUTION: ANY ATTEMPT TO DELIBERATELY DAMAGE ANY WEBSITE OR THE INFORMATION ON A WEBSITE, OR TO OTHERWISE UNDERMINE THE LEGITIMATE OPERATION OF THIS COMPETITION, MAY BE A VIOLATION OF CRIMINAL AND CIVIL LAWS AND SHOULD SUCH AN ATTEMPT BE MADE, WHETHER SUCCESSFUL OR NOT, THE PROMOTER RESERVES THE RIGHT TO SEEK DAMAGES TO THE FULLEST EXTENT PERMITTED BY LAW.

The headings in these Conditions are for convenience only and do not affect interpretation.

 

21. ENTIRE CONDITIONS

These conditions constitute the entire agreement of the parties relating to the entry into and the conduct of this competition.
